FUNDRAISING TERMS AND CONDITIONS
The Royal Brisbane and Women’s Hospital Foundation (RBWH Foundation) supports RBWH, Redcliffe Hospital, the Surgical Trauma and Rehabilitation Services (STARS) and Institutes on the Herston Health Precinct.

By signing up as a fundraiser in support of the RBWH Foundation, you agree to the following terms and conditions.

Letter of Authority to Fundraise
Fundraising activities cannot commence until you have received a ‘Letter of Authority’ (LOA). These are provided:
- for online fundraising – emailed via your registration receipt upon creating an online fundraising page.
- for non-online fundraising – via email from the RBWH Foundation (Community Fundraising Coordinator) upon completion of the Request to Fundraise form.
Once you have received your LOA, you can begin promoting your activity as an RBWH Foundation fundraiser. The RBWH Foundation may at any time, without the need to give any reasons, withdraw the authority to fundraise by notification in writing. You also give consent for the RBWH Foundation to contact you during business hours to discuss your fundraising activities.
Your online fundraising page
Your online fundraising page must reference your support of the RBWH Foundation only (and the organisations we support) and no other charities.
You must ensure that any content you upload onto online fundraising pages is not obscene, offensive, defamatory, discriminatory or racist and does not breach any law or regulation or any intellectual property rights of a third party or any right or duty owed to a third party. This means that if any of the content you upload is copyright protected, you must obtain the copyright owner’s written permission in order to use it. The RBWH Foundation reserves the right to make changes to your fundraising webpage or remove it completely, without prior notice, if it feels you have breached this clause.
Prohibited activities
Please note, there are certain fundraising activities that the RBWH Foundation cannot be associated with, these include activities which
- Promote a high level of personal or public risk.
- May be interpreted as rude, offensive, or inappropriate.
- Do not comply with these terms & conditions.
Code of Conduct, Values and other important policies
You are required to comply with:
- Our Code of Conduct
- Our Privacy Policy
- Our Human Rights Policy, under which anti-discrimination, vilification, workplace bullying and sexual and sex-based harassment are prohibited in accordance with relevant legislation. The RBWH Foundation is committed to upholding the human rights of all individuals.
- Any other important policies that we may share with you from time to time.
Charities Legislation and Regulation
You are responsible for ensuring that your event/activity is conducted in accordance with relevant charities legislation and or regulations in the State or Territory which the fundraising activity is being held and you must obtain any permits, authorities, licences and insurances needed. In Queensland:
- the Office of Fair Trading administers the laws that govern fundraising activities across the state – the Collections Act 1966 (Qld) and Collections Regulation 2008 (Qld).
- the Charitable and Non-Profit Gaming Act 1999 address the conduct of raffles or prize draws.
Different states have their own legislation which you should review before committing to any fundraising event/activity.
Your activities
You agree that your participation in all activities associated with the RBWH Foundation is voluntary. You accept responsibility for the organisation and management of activities, events, finances, prizes, publicity and/or goods and services required to run the event/activity.
You agree to contact the RBWH Foundation before approaching any organisation for sponsorship.
You agree to seek medical advice before partaking in any physical activity and/or you acknowledge that you participate in chosen activities at your own risk and that you are not, to the best of your knowledge, suffering from a condition which would prevent and/or render you unfit to participate in your chosen activities. You agree to take all reasonable measures to protect yourself from the risks of participation.
You confirm that the events and activities you undertake for the RBWH Foundation do not involve any illegal activity, violence, aggression or undue risk-taking. You are responsible for ensuring your personal safety and the safety of your events and activities, including the safety and security of your volunteers and personnel including, but not limited to, organising appropriate public liability insurance and providing first aid services, if required. You must provide a certificate of currency of such insurance upon request from RBWH Foundation. The RBWH Foundation insurance policy does not cover community fundraising events.
You are responsible for any personal possessions you might bring to any activities you undertake for the RBWH Foundation.
You must not undertake any door to door or street sales or cold-call telephone-based approaches for donations to be made in connection with your fundraising/event activity.
Marketing & Media
You agree not to use the RBWH Foundation name or logo without the prior written authority from the RBWH Foundation. You agree that any use of our trademarks, logos, text, images, name or any other branding must first be approved in writing by the RBWH Foundation prior to print.
You agree to speak to the RBWH Foundation prior to undertaking any media activity which refers to RBWH Foundation and any associated other events.
You agree that RBWH Foundation may use your name, the name of your fundraising event/activity and/or a description of your fundraising event/activity to: promote RBWH Foundation initiatives, refer to your association with RBWH Foundation; or comply with any obligations RBWH Foundation may have under applicable laws.
When using social media as part of your fundraising activities or events in support of the RBWH Foundation, you must adhere to the Terms of Use of the relevant social media platform/website, as well as copyright, privacy, defamation, discrimination, harassment, and other applicable laws and the principles of the RBWH Foundation Human Rights Policy.
Banking, transfer of funds and receipting
You are responsible to ensure that all funds raised are kept by you in a secure place and/or are remitted to the RBWH Foundation. You are further responsible to ensure that you maintain complete and accurate records of funds received and expenses incurred as part of your event/activity and that these are sent to the RBWH Foundation upon receiving a written request from RBWH Foundation.
Donations can be made via credit card through online fundraising pages. You will be provided with instructions with respect to other available methods to transfer funds when you are issued your Letter of Authority.
Insurance
You release and indemnify the RBWH Foundation, and any parties associated with fundraising in support of the RBWH Foundation, from any claims, loss or liability of any nature howsoever arising, that RBWH Foundation suffers or incurs, directly or indirectly (whether in contract, tort (including negligence), misrepresentation, breach of statutory duty or otherwise) where the claim, loss or liability arises in connection with:
- a breach of your obligations under these terms and conditions; or
- any wilful misconduct, unlawful or negligent act or omission by you, including claims relating to:
- any injury to or death of any person caused by any act or omission by your or your officers, employees, agents or subcontractors; and
- any damage to real, tangible or intangible property caused by any act or omission by you or your officers, employees, agents or subcontractors.
Involvement of persons under the age of 18
Adult supervision is required for any persons under the age of 18. Written permission may be requested.
